Terms of Service
1. Accepting these terms
By creating an account, accessing, or using Fluency, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the service. You must be at least 13 years old and legally able to agree to these Terms. If local law requires a higher age, that age applies.
2. Your account
Provide an email address you can access, keep your credentials confidential, and notify us if you suspect unauthorized use. You are responsible for activity under your account. Two-step verification is available for additional protection.
3. Using Fluency
Fluency provides educational practice tools, including AI-assisted language, voice, translation, and personalization features. We grant you a personal, limited, non-exclusive, non-transferable, revocable right to use the service under these Terms.
You may not misuse the service, attempt unauthorized access, interfere with its operation, reverse engineer restricted portions, evade limits, upload unlawful or harmful content, infringe another person’s rights, or use Fluency to develop or benchmark a competing model or service without permission.
4. AI and language-learning content
AI-generated translations, explanations, transcriptions, and feedback can be incomplete or wrong. Fluency is a practice tool, not a certified translator, teacher, or source of medical, legal, financial, or emergency advice. Use independent judgment for important communications.
5. Your content
You keep ownership of content you submit. You give Fluency a limited license to host, process, reproduce, and transform that content only as needed to operate, secure, and improve the service. Do not submit content you do not have the right to use or sensitive information you do not want processed by our service providers.
6. Paid features
Some features may require a subscription or purchase. The price, billing interval, trial terms, renewal, and cancellation method will be shown before purchase. Platform purchases are also governed by the applicable Apple or Google terms. Except where law or the purchase terms require otherwise, charges are non-refundable after they are incurred.
7. Fluency content and intellectual property
The service, brand, software, interface, and Fluency-created content are owned by Fluency or its licensors and protected by intellectual-property laws. These Terms do not transfer ownership to you. Feedback you voluntarily provide may be used without restriction or compensation.
8. Availability, suspension, and termination
We may change or discontinue features and may suspend access when reasonably necessary for security, legal compliance, maintenance, or a violation of these Terms. You may stop using Fluency at any time and can delete your account in Account settings.
9. Disclaimers
To the extent allowed by law, Fluency is provided “as is” and “as available.” We disclaim implied warranties, including merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation. Nothing here limits consumer rights that cannot legally be waived.
10. Limitation of liability
To the extent allowed by law, Fluency and its service providers will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost data, profits, or opportunities arising from the service. Our total liability for claims relating to Fluency will not exceed the greater of the amount you paid us in the prior 12 months or US $100. These limits do not apply where prohibited by law.
11. Changes and contact
We may update these Terms as Fluency changes. Material updates will be communicated as required by law. Continued use after an update takes effect means you accept the revised Terms. Applicable law governs without overriding rights you have under local consumer law.
Questions about these Terms can be sent through the Fluency support page.
